TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DOMA FOUNDATION, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO US TO USE THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
You agree to indemnify, defend, and hold harmless the Doma Foundation, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be finally settled by binding arbitration administered by the International Chamber of Commerce in accordance with its arbitration rules. The arbitration shall take place in the Cayman Islands, and the language of the arbitration shall be English.
These Terms constitute the entire agreement between you and the Doma Foundation regarding the Services and supersede all prior agreements and understandings.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, terrorism, riots, war, epidemics, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
